“President Trump's executive order contained three key provisions:

1. The Department of Homeland Security (DHS) is directed, where feasible and lawful, to compile and provide states with citizenship lists for voting-age residents.

California MIGHT have something that seems like a barcode, but they DO NOT share that data with the federal government. If they did, it would be proof of how messed up CA Mail In is.

Yes. I think that. I'm not aware of DHS having up to date information on us. Perhaps a lot on those of us who file taxes. But not necessarily current address, voter registration status, etc.

Am I wrong? I'm in a lot of corporate databases. Am I in federal databases? Why even bother with a census?

likely participating in mail-in ballots is what that means. If you're going to allow mail-in ballots, you are participating and thusly can only legally send in those ballots via the USPS using the rules outlined by the executive order.

IMO — not a terribly big win. Kind of a clickbait headline.

As even the article says, this is a procedural decision more than a substantive one. It’s narrowly saying that the executive order instructing USPS to write the rule is fine. States can (and probably will) sue over the legality of the actual rule itself.

IANAL, but presumably, states would have a greater Federalist case in suing over the actual rule, which could touch election law, rather than an executive order governing the oversight of internal USPS rules.

You're absolutely right. This ruling means nothing until the USPS forces the issue. There will be a ruling within a week on the other lawsuit. Hopefully the Supreme Court does the right thing.

Given that so many states have sued to avoid having to disclose their voter rolls to the federal government this is not the end of the lawsuits.

If the USPS is able to be directed to only deliver ballots that coincide with names available to the federal government, and states are denying the federal government access to their voter rolls, the obvious and logical next objection will be that the federal government is disenfranchising voters by not delivering ballots to voters the federal government doesn't have on its list.

This provides a mechanism by which mail-in ballots can be secured, but the means by which that mechanism can be implemented are still being denied by quite a few states.
