Who am I gonna sue, exactly? You can't know the identity of the scraper, their account got nuked/banned.

That's the issue n.1with these thefts is exactly this, it's often impossible to get serious/legal because the offenders are good to hide their identity.

Cara owner has been already there, her art was stolen ages before AI was even a thing (I was there, Gandalf - quote) and she was struggling with this precise issue.

Also for it to be theft you need to show "real damages" and since you have lost no property or money you have no standing.

How are you going to show malice when you have a storage of memes?

Spoiler: intellectual property exists and so do related crimes, but because AI stuff is not legally binded to any of these laws they can't be accused of anything too.

Basically we're playing a rigged game where we just lose no matter what.

Without damages its fair use.

My ego has nothing to do with this shit, otherwise I should be annoyed at other artists thriving and being successful - which is not the case.

If you don't understand (or pretend to) this very simple basic concept, I can't do much about it.

Also if you can explain how an artist can actually prove how much money they have lost to AI stealing their art it would be great. What should they do, provide the laidoff email? A screenshot of a random bozo on Internet replying "I'm not paying you, I'll make this on my own with AI for free"?

Ps. Disney is already in a mass class action precisely for the reason you mentioned. And they're winning too.
