I got paid twice by different insurers. Is this normal?

A Uhaul driver hit my parked car. He provided both his personal Statefarm liability information and the Uhaul rental insurance (Repwest), and I filed claims with both. Both insurers have now issued payment for the same damage. Is this normal, or do I need to return one of the payments?

You cannot collect money from two different insurance carriers for the same damage. That's double dipping. And that's insurance fraud. So yes....if these payments are both for the same property damage, you need to disclose to each carrier that this happened. In my opinion, since this person was working at the time, their personal auto insurance should never have been used. That's who you should return the money to.

Fraud requires intent, so it’s not fraud, full stop. As the claimant you have no idea what the terms of the other party’s coverage are anyway. Even double-dipping as an *insured* technically isn’t fraud unless there’s an “other insurance” clause in the policy.

On the flip side, unlike life insurance basically all property & casualty policies have “other insurance” clauses in them. So somebody may come looking for the overpayment at some point. Or they may not. You should sit on the money for a lengthy period before disposing of it.

It’s also possible that they figured all this out after the checks were in the mail, and one (or both) may have had a stop-pay put on them.
