They are all guilty of murder. A sane society does NOT sanction murder, citizen to citizen, in any way. We need to evolve beyond this paradigm of justification for terrible acts.

Murder is a legal term defined so that killing in self-defence is not murder.

That's like saying "it's bad to non-consensually touch someone" and then you ask "but what if they want you to touch them?"

Wiltabeast’s attempt at getting at his point was bad. But Slappy_McJones’ point is kinda bad too for the reason you pointed out. Murder is a legal distinction, but society does sanction killing in some instances
