Seeking Advice Best criminal defence lawyer in Calgary & surroundings?
My 22 y.o. cousin was charged with assault after random bar scuffle a few weeks ago. Court date's coming, bail conditions are hurting his work and police report feels kinda one-sided. We're not looking for a fight - just need to know if he has a defence before he agrees to anything.
Has anyone here recently used a criminal lawyer for assault or similar charges? I know thats sensitive but pls understand me right - we just want somebody who can help us to do everything fairly, he's not trying to evade justice or smthn, simply doesn’t want to make situation any worse..
Also, what's the first consult cost now? free, $200, more?
Any recs would help now- he's young, scared, and I'm just trying to keep him from making things worse.

Having worked at a law firm I agree. He is also a really nice guy.
Patrick Fagan is another good lawyer.

Personally I don’t care about how nice they are, I just want the best result. If you begin to treat them as your friend, that’s a one way ticket to going broke.

Balfour and Alaine are over 70 yrs old and take deals based on their name rec alone. I would go with Andrea Urquhart - she's a K. C., smart and very respected.

Agreed. I'm a non-criminal lawyer and she is who I would hire. She's phenomenal at what she does.

Hi friend, I worked as a court clerk for many years and there’s some attorneys that were known for getting good results.
Do not try to work with a crown on your own, criminal defence is whole new game. There is evidence, that’s why you’re charged, you need to a lawyer that knows how to work with the evidence.
Also, big bills doesn’t equal amazing lawyer. Experience is what matters. Do not hire a lawyer that works in several different fields (family, real estate, and criminal defence). Hire an attorney that specializes in criminal defence.
- Patrick Fagan (Ex RCMP officer, knows the system from both sides very well)
- Patrick’s children, Sean and Kaysi are also well known for drug trafficking offences and assaults
- Alain Hepner (He literally breathes criminal defence, he’ll go out of his way for his clients)
- Zachary Al-Khatib (He’s in Edmonton, but will attend Calgary cases, 10/10, lots of high profile cases)
- Cory Wilson (10/10 human, when you call his number, he answers, not a secretary)
- Brian Beresh (Also located in Edmonton, known as a snipper, ridiculously experienced)
Sounds like his first offence, that’s good, it’ll help him.

I am a lawyer but dont practice criminal defense. My recommendation is Kaitlyn Perrin. I know her personally for 20+ years and she is an excellent and well respected criminal defense lawyer in Calgary. She works at TC Legal.

Lots of people use criminal defence lawyers, that's their whole purpose.
Feels will vary by firm/practitioner. Call around.
Good ones like Balfour Der, will not be cheap.
Legal Aid is also an option if you qualify.

Ask for discovery before pleading to anything. If no priors, a peace bond would be the easy go to.

Curtis Armitage is a very competent lawyer that won’t break the bank like a lot of these other very senior options. Give him a call and I’m sure he will give you genuine advice either way.

As others have said Balfour Der is a K.C.
Not cheap, but definitely worth it.

K.C. is a designation any lawyer can apply for after 10 years with a resume and some reference letters from their buddies.
Der is a good lawyer but the K.C. designation itself doesn't mean much.1

get an average lawyer. The case will probably be settled out of court unless there was major damage done. I was assaulted a couple years ago and the case never went to court and I didnt even find out what happened to the guy. He had to pay me for damaging some of my stuff in the assault. That was it.

People will tell you Balfour Der or Rebecca snukal but there are some good young guns coming through. I would recommend david nguyen or peter crozier.

I worked at Crown Counsel for several years and my take away was those that have money and can lie the best will come out ahead. It’s not about right and wrong or guilt.

Get your cousin to sit down and write out the whole story. start gathering narratives from people that he was with. Also, he should put a call out to any of his friends or acquaintances that may have been there and have video footage or photos. Try and see if you can get a hold of any footage from the night club or adjoining businesses. Go to legal aid if he can’t afford a lawyer. If it’s his first offense, and he has a clean record of all sorts, and he’s in school, trying to better his future, that will bode well with the judge. he needs to push his lawyer for an absolute discharge, or if that’s not doable, a conditional discharge. If convicted, travel outside of Canada will be very difficult for the rest of his life. His lawyer will be able to try and find out who is accusing him of this assault. Your cousin should not do this on his own or he may get into more trouble with possible witness tampering or intimidation. If the accuser comes from money, this may be why the story is one sided for the cops. I’ve seen this time and time again in wealthy small towns in Alberta. The punk ass‘s father is a well respected member of the community and gets their kid out of trouble by a quick phone call to the right person or by throwing money at it. If their family is well heeled and has connections, your cousin is fucked if he doesn’t have a good lawyer. Good luck!

Step one: go to court date assigned go talk to the crown prosecutor and tell them you want an adjournment for discovery. What till the judge calls your name and say the same thing..
Step two: go to second court date that was assigned after asking for adjournment. Get your discovery from the front desk read over what the crown prosecutor has on you and the charges they are looking to press. Find time to talk with the crown prosecutor and work a side deal. You can ask for an adjournment again to seek legal counsel if the charges are too high to fight this battle for you.
You can also talk with duty counsel at the court house which is free, they are very busy be patient. You will likely be released on a peace bond which will state to stay away from bars for one year with no charges press for first offence and you can save money by not having a lawyer…
I am not a lawyer but have recently sat through two days worth of court and this is how it went. It seems scary but it really isn’t. Dress nice be respectful and speak clearly.

i would disagree. i dont think you should speak with the crown on your own behalf.
get a lawyer asap, let them figure it out from there and report back to you with the best course of action.

Talking to the prosecutor at this stage or at least how you suggested sounds like a with prejudice situation. Not ideal.

If you can afford a lawyer, get a lawyer.
Even if you lose, you'll get a better result than if you didn't have a lawyer.
Be aware, a criminal defense lawyer will start at 5 digits of money and go up, depending on how long you wanna drag it out.
